GRATUITY CALCULATION IN QATAR


Article 54 of the Qatar labour law states,

The employer shall pay the end of service gratuity to the worker who has completed employment of one year or more. This gratuity shall be agreed upon by the two parties, provided that it is not less than a three-week wage for every year of employment. The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.


The gratuity payment in Qatar is based on the employee’s basic salary and length of service. It may even be reduced depending on the circumstances of the termination of employment and where the employee was working.

WHO IS ENTITLED TO A GRATUITY?

On completion of their contract, international workers are entitled to a gratuity, as long as their contract with that company lasted at least a year. This means it could be thought of as an end-of-service bonus, thanking employees for their service to Qatar.

THERE ARE 3 VARIETY OF GRATUITY FACILITIES:

  • Below 5 years - Eligible to get 21 calendar days’ salary for each year of service in the first five years of employment
  • Between 5 to 10 years - Eligible to get 4 weeks (28 days) calendar days’ salary for each year of service worked beyond five years
  • Higher than ten years – Eligible to get 5 weeks (35 Days) of your salary as a gratuity


FORMULA FOR CALCULATING GRATUITY

Basic Salary/30 (one month) X 21 days (three Weeks) x Year

Example (1) : BASIC SALARY – 3000 , 2 Years Working in a company 

Then,

QR 3000÷30 = QR 100 (One day salary)
QR 100 x 21 = QR 2100 (21 Days Salary) 
QR 2100 x 2 =   QR 4200 (Your total 2 Years of Bonus)

The Ministry of Administrative Development, Labour and Social Affairs has launched a new electronic service that allows expatriate workers to calculate their end of service gratuity.

NOTE:
According to Article 61 of the Labour Law, there are cases in which an employer may dismiss an employee without payment of the end of service gratuity.
Instances of gross misconduct include the violation of written instructions pertaining to worker safety, employee intoxication while at work, and the disclosure of secret information regarding the employer.

  1. I have been working for the last 12 years in Qatar.

    My Date of joining is 30th June 2008
    Last Working Day 30th June 2020.

    Company HR representatives informed me that they will pay 21 days for my gratuity. As per Qatar Labour law can you please confirm it is right.

    Some of my colleagues said after five years the company needs to pay 28 days for Gratuity.

    can you please help me conclude this for my eligible 28days or 21 days.

  2. Could you kindly clarify the calculations of my gratuity, due to the pandemic situation my company is terminating employees, unfortunately I am one of it. I am with the company for for more than 7 years now and as per my employment offer they mentioned that my EOS will be 30 calendar days per year, but now, suddenly they are changing the EOS calculations from 30 days to 21 days. In the Qatar labor law they didn't stipulate the 3 variety of gratuity facilities.

    1. Assume that your salary is QR 2000
      your total service period is 7 years.

      Calculating formula: Basic Salary / 30 (one month) x 28 (4 Weeks) x Years

      QR 2000÷300 = QR 66.66 (Your One day salary)

      QR 66.66 x 28 Day = 1866.48 (Your 28 days salary)

      QR 1866.48 x 7 years = 13065.36 (Your Total 7 years of gratuity)

  3. what if the company is not declaring the true salary of the employee. what if its lower than the actual. then the gratuity computation will be much lower. where can he file his complaint about this thanks. what document can he show to prove it.

  4. I m a house driver I have been working from 2012 to till now. I want to quit my job this year on December so could u tell me i get my gratuity or not if I get then how much I will get because I m house driver and till now in my work period I don't get any single QR accept my salary. My salary is 1600
